Welcome to ConstructionStaff! These Terms and Conditions ("Terms") govern your use of constructionstaff.com (the "Site") and the staffing services provided by ConstructionStaff LLC ("we," "us," or "our").

By accessing or using our Site, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

• "Service" refers to the staffing and recruitment service provided by the Site that connects independent skilled tradespeople with companies.
• "User" refers to any individual or entity accessing the Service.
• "Tradesperson" refers to a User registering to be considered for construction work placements.
• "Company" refers to a User seeking to hire or contract skilled construction personnel.
• "Content" refers to text, images, resumes, job descriptions, or other information posted by Users.

2. The Service

ConstructionStaff is a staffing and recruitment agency operating in the State of Texas. We maintain our own pool of screened Tradespeople and introduce them to Companies seeking construction personnel.

• For Companies: We take your role requirements, source and screen candidates from our pool, and present a shortlist for your selection.
• For Tradespeople: We assess your trade experience and certifications and put you forward for suitable placements at no cost to you.

Important Disclaimer: While we screen every candidate we present, we do not guarantee that a Company will select a suitable Tradesperson, nor that a Tradesperson will be placed. Unless expressly agreed in writing, the employment or contracting agreement is entered into directly between the Company and the Tradesperson, and we are not a party to it. Any placement guarantee applies only as stated in the written agreement signed with the Company.

3. Accounts and Registration

To access the matching features, you must register for an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or suspect any security breaches.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading (e.g., fake resumes or fraudulent job postings).

4. User Responsibilities

A. Tradespeople

By creating a profile, you represent that:

• Your resume, certifications, licences, and work history are accurate.
• You have the legal right to work in the jurisdictions you select.
• You will conduct yourself professionally in all interactions with Companies.

B. Companies

By posting a position, you represent that:

• The job description is accurate and the position is currently open.
• You have the legal authority to hire or contract for the position.
• You will comply with all applicable labor and employment laws, including anti-discrimination regulations.

5. Fees and Payments

Our services are free of charge for Tradespeople at all times. We never charge a candidate to be screened, presented, or placed.

Companies pay a one-time placement fee for each Tradesperson they hire. The fee is agreed in writing before a search begins. No fee is payable if no placement is made. There are no subscriptions and no recurring charges.

6. Relationship of Parties

You acknowledge and agree that ConstructionStaff is an independent contractor for all purposes and is not your employer, employee, agent, or partner.

No Employment Relationship: Use of the Site does not create an employment relationship between the Tradesperson and ConstructionStaff. Any employment or independent contractor agreement is strictly between the Company and the Tradesperson. ConstructionStaff is not responsible for the payment of wages, commissions, benefits, or tax withholdings.

7. Intellectual Property

The Site and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of ConstructionStaff.

By posting Content (e.g., resumes, logos, job posts) to the Site, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such Content for the purpose of operating and promoting the Service.

8. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose.
• Harass, abuse, or harm another person.
• Scrape or copy profiles and data for use on a competitor’s site.
• Post false, misleading, or defamatory content.
• Bypass or tamper with the security of the Site.

9. Limitation of Liability

In no event shall ConstructionStaff, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Specifically: We are not liable for any disputes, financial losses, or legal issues arising from the relationship between a Tradesperson and a Company.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

12. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
